Auto Liability Program

The State of Illinois self insures its automobile liability exposure resulting from motor vehicle accidents when state employees operate state owned or leased vehicles in the course of their employment. There is no coverage provided to state employees if they operate a state owned vehicle out of the course of their employment.

The State of Illinois Self Insured Motor Vehicle Liability Plan provides coverage of two million dollars per occurrence on a combined single limit. As a condition of coverage under the Plan, an employee involved in a motor vehicle accident is required to provide a written report, in a prescribed format, within seven calendar days to the Plan Administrator. All State Departments, Boards, Commissions, Universities, and Agencies are provided coverage under the Plan. Each Department, Board, Commission, University, and Agency is to have one or more Auto Liability Coordinators to act as a liaison between their respective Department and the Plan Administrator. The Auto Liability Coordinators are responsible for fulfilling their duties as outlined by the Plan Administrator.

Staff adjusters investigate the claims submitted. The liability exposure is determined, and when appropriate, the case is evaluated for settlement purposes. The adjusters negotiate settlements with the damaged individual or their legal representative. Claim payments are processed through the Plan Administrator and paid from an annual appropriation as approved by the Legislature.

The Attorney General's Office is the designated defense counsel for claims in which suits are filed against the state driver and/or the State of Illinois.

Any physical damage to state owned vehicles involved in accidents is managed by the agency operating the vehicle.

Auto Liability issues may be directed to the Auto Liability Coordinator at the employing agency or university.
